It should be read with our Website Terms and Conditions.

For the DPDP Act, the Company is the “Data Fiduciary” for personal data collected through the Website.

2. Scope

This Policy applies to visitors to the Website and to people who contact us through it. Personal data we handle while providing our services to customers is governed by the applicable customer agreement (such as the services agreement or a data processing addendum), under which we act on the client’s instructions.

We do not knowingly seek sensitive personal data through the Website. Please do not send passwords, credentials, financial account details or confidential business data through forms or email. If we need such information for a project, we will agree a secure method with you first.

4. Why We Use Your Data

We process personal data only for specified, lawful purposes:

  • to respond to your enquiries, prepare proposals and quotes, and communicate with you;
  • to enter into and manage a contract with you or your organisation, where you become a customer;

  • to send service updates, and, where you have agreed, newsletters or marketing communications;
  • to comply with legal, tax, accounting and regulatory obligations, and to establish, exercise or defend legal claims.

5. Legal Basis and Consent

We process personal data on the basis of:

  • your consent, which you give by submitting a form or ticking the consent box. Consent is free, specific, informed and unambiguous, and you may withdraw it at any time (see section 11);
  • legitimate uses permitted by the DPDP Act, such as responding to a request you voluntarily made, performing a contract, or complying with law.

A notice at the point of collection lists the data we collect and the purpose. We do not use your data for any purpose materially different from that notified without fresh consent.

6. Sharing and Disclosure

We do not sell your personal data. We share it only as needed with:

  • Service providers who help us run the Website and our business, such as web hosting, email, analytics, CRM, ticketing and communication tools [list providers, e.g. hosting, email, analytics and CRM providers], under confidentiality and data protection obligations;

7. Transfers Outside India

Some of our service providers (for example email, analytics or cloud tools) may store or process data on servers outside India. Where this happens, we transfer data only to the extent permitted under the DPDP Act and any restrictions notified by the Central Government, and we use providers that apply appropriate security safeguards.

8. Cookies and Analytics

The Website uses cookies and similar technologies for the following:

You can manage or delete cookies through your browser settings. Blocking essential cookies may affect Website functionality.

9. Data Retention

We keep personal data only as long as needed for the purposes in section 4, or as required by law:

  • enquiry data that does not lead to a contract: up to 12 months after our last communication;
  • client contract and billing records: for the period required by applicable tax, accounting and company law (generally 8 years);
  • Website analytics: 26 months or less.

After that, we erase or anonymise the data, unless retention is required by law or for a pending legal claim.

10. Security

We use reasonable security practices and procedures appropriate to the nature of the data, including access controls, encryption in transit (HTTPS), patching, backups and restricted staff access. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

If a personal data breach occurs that affects you, we will notify you and the Data Protection Board of India as required by the DPDP Act.

11. Your Rights

Under the DPDP Act you may:

  • access a summary of the personal data we process and the identities of those we have shared it with;
  • correct or update inaccurate or incomplete data, and erase data that is no longer needed for its purpose;
  • withdraw consent at any time. Withdrawal does not affect processing done before withdrawal, and we may be unable to continue a service that depends on that data;
  • seek grievance redressal (section 14);
  • nominate another person to exercise your rights in the event of your death or incapacity.

To exercise any right, email grievance@bitbyte.net.in from the address you used with us. We may need to verify your identity first, and we will respond within 30 days or any shorter period required by law.
