1. Acceptance and Eligibility

By accessing or using bitbyte.net.in (the “Website”), operated by BitByte IT Solutions (“BitByte”, “we”, “us”), you agree to these Terms of Use and our Privacy Policy. If you do not agree, please do not use the Website. You must be at least 18 years old and competent to contract under the Indian Contract Act, 1872. If you use the Website for a business, you confirm you can bind that business. These Terms are an electronic record under the Information Technology Act, 2000 and need no signature.

2. Website and Services

The Website provides general information about our managed IT services. It is an invitation to enquire, not an offer, and no contract for services is formed through it. Any services we provide are governed only by a separate written agreement (such as a Master Services Agreement, Service Level Agreement or signed quotation), which prevails over these Terms for those services.

3. Intellectual Property

All content on the Website, including text, graphics, logos, the BitByte name and software, is owned by or licensed to BitByte and protected under Indian intellectual property laws. You may view and print content for your own internal, non-commercial reference. Any other use or reproduction needs our prior written consent. Third-party names and trademarks belong to their owners.

4. User Conduct

You agree to use the Website lawfully and not to:

  • engage in fraudulent or unlawful activity, or upload content that is defamatory, obscene or infringing;
  • attempt unauthorised access to the Website, our servers or connected systems, or run vulnerability scans or penetration tests without our written consent;
  • introduce malware or harmful code, or disrupt the normal working of the Website;
  • scrape or copy Website content by automated means without our permission;
  • impersonate any person or misrepresent your affiliation.

Please do not send passwords, credentials or confidential client data through the Website forms.

We handle personal data as described in our Privacy Policy and in line with applicable Indian law. The Website may link to third-party sites that we do not control, and we are not responsible for their content or privacy practices.

6. Disclaimer and Limitation of Liability

The Website and its content are provided “as is” and “as available”, without warranties of any kind, to the extent permitted by law. We do not guarantee uninterrupted, error-free or secure access. Technical articles and guides are general information, not advice tailored to your systems, so test and back up before making changes.

To the maximum extent permitted by law, BitByte and its personnel are not liable for indirect or consequential loss, or for loss of profit, data or business arising from your use of the Website. Where liability cannot be excluded, our total liability is limited to INR [amount, e.g. 10,000]. Nothing here excludes liability that cannot be excluded by law, including for fraud. You agree to indemnify BitByte against claims arising from your breach of these Terms or misuse of the Website.

7. Governing Law and Disputes

These Terms are governed by the laws of India. The parties shall first try to resolve any dispute through good-faith discussion for 30 days from written notice. Failing that, the dispute shall be finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, before a sole arbitrator mutually appointed by the parties, with the seat and venue in Bengaluru and the language English. Subject to this, the courts at Bengaluru, Karnataka have exclusive jurisdiction.

8. Changes, Termination and General

We may update these Terms from time to time by posting the revised version here with a new date; continued use means you accept it. We may suspend or restrict access to the Website at any time for breach, security or maintenance reasons. If any provision is held invalid, the rest continues in force. Failure to enforce a provision is not a waiver. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Website.

9. Grievance Officer and Contact

We will acknowledge complaints within 24 hours and aim to resolve them within 15 days, or such other period as the law requires.
